1. About Uncharted by Us

Uncharted by Us is a travel-planning service offering curated travel itineraries and tools that may allow users to discover destinations, save and customize trips, organize travel plans, add notes and photos, manage travel budgets and expenses, access maps and place information, and use other travel-related features.

Our itineraries and recommendations are intended to help you plan travel based on curated information, including our own travel experiences and research. They are not intended to replace your own assessment of current travel conditions or information provided by official authorities and travel providers.

Features, destinations, itineraries and availability may change over time as the Services evolve.

2. Eligibility and Accounts

You must be at least 18 years old to create an account or use the Services.

• You agree to provide accurate information when creating your account and to keep your login credentials secure.
• You are responsible for activity occurring through your account and should notify us promptly if you believe your account has been accessed without authorization.
• You may sign in using supported authentication methods, which may include email/password, Sign in with Apple, or Google Sign-In.
• You may not create accounts using automated means, impersonate another person, attempt to gain unauthorized access to another user's account, or use the Services for fraudulent or unlawful purposes.

3. Free and Premium Services

Uncharted by Us may offer both free and paid features.

The features included in each plan may be displayed within the App or associated purchase interface and may change as the product evolves.

Some features, destinations, itineraries, content, usage levels or functionality may be available only to users with Premium access.

We may introduce, modify, discontinue or reorganize features or plans over time. We will not intentionally remove access to a paid entitlement during the period for which you have already paid, except where necessary for legal, security or technical reasons.

4. Subscriptions and Payments

Premium features may be available through auto-renewable subscriptions or other purchases offered through the Apple App Store or another supported platform.

The applicable price, currency, subscription period, trial or promotional terms, and features included will be shown to you before you complete a purchase.

For purchases made through Apple's App Store:

• payment is charged through your Apple Account;
• subscriptions automatically renew unless cancelled in accordance with Apple's applicable subscription rules;
• subscription management and cancellation are handled through your Apple Account/App Store subscription settings;
• any applicable free trial or introductory offer will be presented before purchase; and
• refunds are handled in accordance with Apple's applicable policies and any mandatory rights available under applicable law.

Deleting your Uncharted by Us account does not necessarily cancel an active App Store subscription. If you have an active subscription, you should also manage or cancel it through the platform through which you purchased it.

We may change subscription prices or available plans in the future. Changes affecting existing subscriptions will be handled through the applicable app-store platform and in accordance with applicable law.

5. Early Access, Founding Traveler and Promotional Rewards

We may provide promotional access, referral rewards, complimentary Premium access, early-access benefits, or other incentives to eligible users.

For example, promotional programs may include benefits for early users or users who successfully refer other genuine users.

Eligibility and the exact reward may depend on the terms communicated for the relevant promotion.

Referral signups must represent genuine individual users. Fake, duplicate, automated, self-referral, manipulated, or fraudulent signups do not qualify.

We may verify eligibility before granting a promotional reward and may revoke a reward obtained through fraud, abuse, misrepresentation or violation of these Terms.

Promotional programs may be modified, suspended or discontinued, subject to benefits already validly granted and applicable law.

6. Lifetime Premium

Where we have expressly granted a user Lifetime Premium, “Lifetime” means access for the lifetime of the Uncharted by Us product/service, rather than the lifetime of the individual user or any specific company.

Lifetime Premium does not guarantee that Uncharted by Us will operate indefinitely or that every current or future feature will always be included.

We may evolve the product, introduce new products, services, tiers or separately priced functionality, or modify existing functionality over time.

However, we will not arbitrarily revoke a valid Lifetime Premium entitlement solely to require the same user to purchase an equivalent Premium entitlement again.

Lifetime Premium may be subject to reasonable usage limits necessary to protect the security, availability, cost and integrity of the Services.

7. Travel Information and Recommendations

Travel information can change rapidly.

Although we aim to provide useful and accurate information, we cannot guarantee that every itinerary, recommendation, price, opening time, route, travel time, hotel, restaurant, attraction, visa requirement, entry requirement, health requirement, safety condition or other travel-related detail will always be complete, accurate or current.

You are responsible for verifying important information with appropriate official or primary sources before making travel decisions.

In particular, you are responsible for checking matters such as:

• passports, visas and entry requirements;
• vaccinations and health requirements;
• travel advisories and local safety conditions;
• weather and environmental conditions;
• opening hours and availability;
• transport schedules and road conditions;
• booking terms and cancellation policies; and
• insurance requirements.

Travel involves inherent risks. You remain responsible for deciding whether a destination, activity, route or recommendation is appropriate for you.

Nothing in the Services constitutes legal, immigration, medical, safety or other professional advice.

8. Maps, Routes and Location Information

The Services may display maps, routes, distances, estimated travel times, place information and your current position on a map.

Map, route and place information may be provided through third-party services such as Google Maps.

Routes, travel times, distances and location information are estimates and may be inaccurate or unavailable due to road closures, traffic, weather, mapping errors, connectivity or other circumstances.

Do not rely on the App where doing so could create a safety risk. You are responsible for following road signs, local rules, official warnings and actual conditions.

9. Third-Party Services, Bookings and Affiliate Links

Uncharted by Us may link to third-party travel services, including accommodation providers, activity and tour providers, hiking services, transportation providers, car-rental companies and other travel-related services.

Some links may be affiliate links. If you follow an affiliate link and subsequently make a booking or purchase, we may receive a commission from the third-party provider, generally at no additional cost to you.

Unless explicitly stated otherwise, Uncharted by Us is not the seller or provider of third-party accommodation, flights, activities, tours, transport, rentals or other travel products.

Any booking, purchase, cancellation, refund, dispute, service failure or other transaction with a third party is between you and that provider and is governed by the provider's own terms and policies.

We do not control and cannot guarantee the availability, quality, accuracy, safety, performance or conduct of independent third-party providers.

The inclusion of a link, recommendation or affiliate relationship does not constitute a guarantee of the third party's services.

10. User Content

The Services may allow you to create, upload or store content such as customized itineraries, trip notes, photographs, trip covers, expense labels and other information (“User Content”).

You retain ownership of User Content that you own.

You grant us a limited, non-exclusive license to host, store, reproduce, process and display your User Content solely as reasonably necessary to operate, provide, secure and improve the Services.

This license ends when the relevant User Content is deleted from our active systems, except where temporary retention is technically necessary, legally required, or permitted under our Privacy Policy.

You are responsible for ensuring that you have the right to upload and use any User Content you provide.

You must not upload content that:

• infringes another person's intellectual-property or privacy rights;
• is unlawful, fraudulent, abusive or malicious;
• contains malware or harmful code; or
• is intended to interfere with the Services.

Your private notes and personal travel content are not converted into Uncharted by Us-owned content merely because you store them through the Services.

11. Uncharted by Us Content and Intellectual Property

The Services and their original content, including our curated itineraries, original descriptions, editorial recommendations, “Note from Us” content, design, branding, logos, graphics, interface elements and other materials created by or for Uncharted by Us are owned by or licensed to Rensapp Technology SRL and are protected by applicable intellectual-property laws.

We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use this content for your own personal, non-commercial travel planning.

You may not, without our prior written permission:

• reproduce or redistribute substantial portions of our curated itineraries or content;
• republish our content as your own;
• sell or commercially exploit our itineraries;
• systematically scrape, extract or download our content;
• use automated tools to build a competing database or service from our content; or
• remove copyright, trademark or ownership notices.

You may use ordinary screenshots or share functionality for personal, non-commercial purposes, provided this does not amount to systematic copying or redistribution of our content.

Third-party names, trademarks, photographs, maps and other third-party materials remain the property of their respective owners.

12. Acceptable Use

You agree not to misuse the Services.

You may not attempt to:

• access accounts, systems or data without authorization;
• circumvent Premium access controls or usage limitations;
• interfere with the security or operation of the Services;
• reverse engineer the Services except where applicable law expressly permits it;
• scrape or systematically extract our database or curated content;
• use automated systems to abuse referral or promotional programs;
• introduce malicious software;
• use the Services for unlawful activities; or
• infringe the rights of Uncharted by Us or third parties.

We may restrict or suspend access where reasonably necessary to protect the Services, other users or our rights.

13. Account Deletion

You may delete your Uncharted by Us account using the Delete Account functionality available within the App.

Account deletion removes your account and associated user data from our active application systems as described in our Privacy Policy, subject to information that we may be required or permitted to retain.

Deleting your account may permanently remove saved trips, notes, photographs, budgets, preferences and other User Content associated with the account.

Account deletion is generally irreversible.

As explained above, deleting your Uncharted by Us account does not necessarily cancel an active subscription purchased through Apple or another third-party platform. Subscription cancellation must also be handled through the relevant platform where required.

14. Suspension and Termination

We may suspend or terminate access to the Services if you materially violate these Terms, use the Services fraudulently or unlawfully, threaten the security or integrity of the Services, or create significant risk or harm to us, our users or third parties.

Where reasonable and appropriate, we may provide notice or an opportunity to remedy the issue before termination.

You may stop using the Services at any time and may delete your account through the App.

Sections that by their nature should survive termination, including intellectual-property provisions, limitations of liability and applicable-law provisions, will continue to apply.

15. Availability and Changes to the Services

We aim to keep the Services available and useful, but we do not guarantee uninterrupted or error-free operation.

The Services may occasionally be unavailable because of maintenance, technical problems, third-party outages, updates or circumstances beyond our reasonable control.

We may add, modify or discontinue functionality as Uncharted by Us evolves.

If a material change affects a paid service, we will handle it in accordance with applicable law and relevant app-store requirements.

16. Disclaimers

To the extent permitted by applicable law, the Services are provided on an “as available” basis.

We do not guarantee that travel information, recommendations, third-party information, maps, prices, availability or other content will always be accurate, complete or current.

Recommendations reflect editorial judgment and travel experiences and may not be suitable for every traveler.

Nothing in these Terms excludes warranties, consumer rights or other protections that cannot lawfully be excluded.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Rensapp Technology SRL will not be liable for indirect, incidental, special or consequential losses arising from your use of the Services, reliance on travel information, actions of independent third-party providers, or circumstances outside our reasonable control.

We are not responsible for losses caused by independent airlines, hotels, booking platforms, activity providers, transportation companies, restaurants or other third-party providers.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including liability that cannot legally be excluded under applicable consumer-protection law.

18. Privacy

Our processing of personal information is described in the Uncharted by Us Privacy Policy.

The Privacy Policy explains what information we collect, how we use it, the service providers involved, your privacy rights, and how account and data deletion work.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Services, applicable laws or our business practices.

The updated Terms will display a revised “Last updated” date.

Where changes materially affect your rights or obligations, we may provide additional notice where appropriate or required by law.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms where permitted by applicable law.

20. Governing Law and Consumer Rights

These Terms are governed by the laws applicable to Rensapp Technology SRL in Romania, without depriving consumers of mandatory protections available to them under the laws of their country of residence where those protections apply.

If you are a consumer in the European Economic Area or another jurisdiction with mandatory consumer-protection rights, nothing in these Terms limits those rights.
